People confuse mediation with arbitration. Both are nonjudicial ways to resolve disputes. However, Arbitration, like a lawsuit, results in a binding decision handed down by the arbitrator, who’s like a judge. Mediators, by contrast, have no power to impose a decision. Their job is simply to help the parties work out a mutually acceptable solution to their dispute. If both sides desire to craft a resolution that both want to be binding, we assist them in doing so.

If you are unsure of your legal rights, consult an attorney before the session. The mediator’s role is neutrality and to facilitate discussion. The mediator may not give legal advice.

Do your homework. Bring the financial documents (leases, receipts, court judgements, etc.) and photograph documents that support your side of the dispute. There are probably many issues you have thought about in anticipation of the mediation session – write them down and bring them with you. Parties emotionally involved during the mediation session may forget to address an important concern. Clearly identifying issues beforehand not only keeps the discussion focused, it ensures a more thorough settlement agreement when one is reached.

In addition to writing down the issues, think about various financial solutions that you are willing to present and discuss.

Your mediation session may take time to complete – be prepared to commit at least 2 hours to the session.
